DamaSight Terms of Use

DamaSight is a pattern-design and process-exploration app provided by the independent developer identified under Provider and legal contact. In these Terms, “we”, “us” and “our” refer to that developer. These Terms cover the DamaSight iOS app distributed through the Apple App Store, its in-app feature unlock, and the product information, tutorials and interactive examples on the official DamaSight website.

The Apple Standard End User License Agreement governs the software license. These Terms supplement that license with information about DamaSight's service, purchases and support. They do not remove rights that applicable law does not allow us to exclude.

Pattern design and process exploration

DamaSight lets you arrange two materials in a starting billet, apply supported process steps, inspect material sections, and save a project for further editing. A project may include its name, dimensions, material arrangement, process parameters and viewing settings.

The app uses prescribed material transformations to generate simulated patterns, sections and process results for design exploration and reference only. We do not guarantee that actual forging, cutting, grinding or etching will produce final patterns or finished results matching the simulation displayed by the app. The simulation is not a calibrated prediction of actual hot-metal flow, welding quality, fracture, heat treatment, final strength or etched appearance. Actual results depend on materials, equipment, temperature, friction, losses and handling that the app does not fully represent. Higher rendering resolution or anti-aliasing improves the sampled display; it does not establish greater physical accuracy.

Use the preview and reports as design references, and assess the suitability and safety of any real process independently. Follow appropriate equipment, tool and workshop safety practices. The app does not certify a billet, tool, product or manufacturing method as safe or fit for a particular purpose.

Website tutorials and interactive examples explain design and process principles. They do not replace professional training, safe operating procedures or process validation for your materials, equipment and working conditions. Tutorials may discuss processes not currently implemented in the app; describing a process does not mean the app provides that feature.

To the extent permitted by applicable law, we are not responsible for the results of physical processing you independently undertake using the simulation as a reference, or for losses of materials or finished products caused by differences between the simulation and actual processing. This statement does not exclude liability or statutory consumer rights that cannot lawfully be excluded.

Free features and the full-version unlock

The free experience includes the Initial layouts, Forge and Cut / reassemble processes, material-section viewing, and local project saving. Free rendering choices are Low and Standard, with material-rendering anti-aliasing off.

The full-version unlock enables Twist, Imprint, Plane cut and Add steel in your own projects, Fine and Ultra rendering, optional anti-aliasing settings labelled x2, x4, x16 and x32, and all PDF report export. Supported inputs and device capabilities still apply to all features.

Before purchasing, review the features and full local price shown in the app and Apple's purchase confirmation. The unlock covers the features described for that product at the time of purchase. Ordinary updates or changes to these Terms do not, by themselves, cancel a valid paid unlock.

One-time purchase and verification

The full-version unlock is a non-consumable in-app purchase through Apple. It is a one-time payment, not an automatically renewing subscription, and is not used up by ordinary use or the passage of time. You are not charged monthly or annually for this unlock.

Apple charges the Apple Account used for the purchase. Access is enabled after a valid purchase is verified. Cancelled payments, uncompleted purchases and orders awaiting approval are not verified purchases. If a purchase is refunded or revoked, the related access may change according to the platform's verification and applicable law.

The purchase is for DamaSight. It does not purchase the app's source code, physical materials or tools, or paid access to another standalone app. Software availability also depends on compatible devices, operating systems and platform services; this does not limit any statutory remedy you may have.

Restoring access and keeping projects

Eligible purchases can be restored using the Apple Account that made them and the app's Restore Purchases control. A network connection may be needed. You do not need a separate DamaSight account. Availability on other devices and Family Sharing depend on the purchase configuration and Apple's applicable usage rules.

Restoring purchases restores eligible feature access. It does not recover projects, settings, backups or files that were deleted or stored only on another device. DamaSight does not provide its own cloud project-sync service. System backups and device migration are managed separately through your device and platform settings.

A PDF is a report, not a complete editable-project backup. Keep appropriate copies or device backups before removing the app, replacing a device or deleting project data. Contact support before resetting an installation containing work you need to preserve.

Refunds and consumer rights

For purchases billed by Apple, follow Apple's refund instructions or visit reportaproblem.apple.com. Eligibility and handling vary by purchase and region. We can help resolve access problems but cannot decide a refund request on Apple's behalf.

Nothing in these Terms excludes applicable rights relating to refunds, defective digital content, repairs, replacements, privacy or other mandatory consumer protections. Contacting us does not prevent you from exercising those rights or seeking help from a competent authority.

Your designs and application materials

We do not claim ownership of your original designs, process recipes, project data or reports merely because you use DamaSight. You may use your own work for personal and commercial purposes, subject to any rights in third-party material you choose to use. The app does not guarantee that a pattern is exclusive, patentable or free of third-party rights.

Rights in the app software, bundled assets, documentation and other supplied materials remain with us or their respective rights holders. Your purchase grants access under the applicable license; it does not transfer ownership of those materials. Do not redistribute proprietary app files or bypass paid-access controls without authorization. Rights granted by applicable law and third-party or open-source licenses remain unaffected.

Responsible use and service changes

Use the app lawfully and respect other people's rights. If a minor uses the app, a parent or guardian should manage purchases and any real-world work involving heat, machinery or tools in accordance with applicable law.

We may issue corrections, compatibility updates and other changes to the app. We aim to provide a reliable service, but cannot promise uninterrupted operation or recovery of every local file. Any limitation on warranties or responsibility applies only to the extent permitted by applicable law. These Terms do not limit liability that cannot lawfully be limited.

Privacy and updates to these Terms

The Privacy Policy explains local project data, purchases and information you choose to send to support.

We may update these Terms to reflect changes in the app, purchases or applicable law. We will update the effective date and provide any notice required for material changes. Changes will not, by themselves, remove valid paid access or override mandatory protections that apply to you.
